Terms of Service
The rules for using MyBiznest as a customer, guest, business, or staff member.
1. About these terms
MyBiznest is an online marketplace that lets independent businesses list their services and products, take bookings and orders, message customers, and optionally accept card payments online. These Terms of Service form a binding agreement between you and MyBiznest and apply every time you use the platform.
These terms apply to everyone who uses MyBiznest: customers with accounts, guests who book or order without an account, business owners, and staff members invited to a business account. Businesses are also bound by the Business / Seller Agreement, and paid plans are also governed by the Subscription Terms.
If you do not agree to these terms, do not use MyBiznest.
2. MyBiznest is a marketplace, not the provider
Every service and product on MyBiznest is offered, priced, described, scheduled, fulfilled, and guaranteed by the independent business that listed it. MyBiznest is not the seller, service provider, employer, agent, or insurer of any business on the platform.
MyBiznest does not verify the quality, legality, safety, licensing, or suitability of any listing, and does not guarantee that a business will complete a booking or order. Contracts for services and products are formed directly between the customer or guest and the business.
3. Accounts, guests, and staff
You must be at least 18 years old, or the age of majority where you live, to create an account or transact on MyBiznest. Account information must be accurate and kept up to date.
You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us immediately if you believe your account has been accessed without your permission.
Guests may book and order without creating an account. Guest activity is tied to the email address supplied at the time and is accessed through a secure private link. Anyone holding that link can view that booking or order, so do not share it.
Staff members act on behalf of the business that invited them, within the permissions that business grants. Business owners are responsible for their staff's activity on the platform.
4. Bookings and orders
When you request a booking or place an order, you are making a commitment to the business under its own terms, including its cancellation, return, and refund policy, which is shown to you before you confirm.
Prices, availability, durations, fulfillment options, and delivery times are set by the business. MyBiznest displays them but does not control them.
Where you pay online, a booking or order is only confirmed once the payment provider confirms the payment succeeded. Slots held during checkout expire if payment is not completed in time.
5. Payments, refunds, and off-platform payments
Online card payments on MyBiznest are processed by Stripe. Fees applicable to online payments are described in the Payments & Platform Fees policy and are shown before you pay.
Only payments successfully processed through MyBiznest using Stripe are eligible for refund processing through MyBiznest.
Payments made directly to a business or otherwise outside MyBiznest — including cash, external payment apps, bank transfers, or card payments the business processes independently — are not processed, verified, monitored, or tracked by MyBiznest and are not eligible for refunds through MyBiznest.
Any refund involving an off-platform payment must be handled directly between the customer and the business.
Being eligible for a refund does not guarantee a refund. Refunds processed through MyBiznest and Stripe remain subject to the applicable business refund and cancellation policy, these terms, Stripe and card-network requirements, and applicable law.
6. Acceptable use
When using MyBiznest you agree not to:
- Break the law, infringe anyone's rights, or list anything covered by the Prohibited Products & Services policy.
- Impersonate another person or business, or misrepresent your identity, licensing, or affiliation.
- Take payments off-platform in order to avoid platform fees where you have agreed to accept online payment for that transaction.
- Harass, threaten, or abuse other users, including through messaging and reviews.
- Upload malware, scrape the platform, probe or bypass security controls, or interfere with normal operation.
- Use another user's account, private guest link, or private records without authorisation.
7. Content you provide
You keep ownership of the text, photos, and videos you upload. You grant MyBiznest a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute that content for the purpose of operating and promoting the platform.
You confirm you have the rights to everything you upload. Content that breaches these terms, the Community / Review Guidelines, or the Copyright / IP Policy may be removed.
8. Messaging and notifications
Messages sent through MyBiznest are visible to the participants of that conversation and may be reviewed by MyBiznest for safety, fraud prevention, dispute resolution, and legal compliance.
Transactional emails and notifications about bookings, orders, payments, and account security are part of the service. Marketing emails are optional and can be turned off in notification settings.
9. Suspension and termination
You may stop using MyBiznest at any time and may request deletion of your account from your settings. Businesses with active bookings, orders, or subscriptions should settle them first.
We may suspend or terminate access where there is a breach of these terms, a legal requirement, suspected fraud or abuse, repeated chargebacks, or risk to other users or the platform. Where reasonable we will explain the reason and give you an opportunity to respond.
Termination does not remove obligations already incurred, including amounts owed and records we are required to retain.
10. Disclaimers and liability
MyBiznest is provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation, and we are not responsible for the acts, omissions, or content of businesses, customers, guests, or staff.
To the maximum extent permitted by law, MyBiznest is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the platform is limited to the greater of the platform fees you paid to MyBiznest in the three months before the claim, or fifty US dollars.
Nothing in these terms limits liability that cannot be limited under applicable law, including consumer rights that apply to you.
11. Disputes
Disputes about a service or product should first be raised with the business directly through MyBiznest messaging, and then through the refund request or support process. Payment disputes and chargebacks are covered by the Disputes & Chargebacks policy.
These terms are governed by the laws of the jurisdiction in which MyBiznest is established, without regard to conflict-of-law rules, and subject to any mandatory consumer protections in your country of residence.
12. Changes to these terms
We may update these terms. The version number and effective date at the top of this page always show the current release. Material changes are notified in the app or by email before they take effect.
Acceptances recorded when you signed up, and the policy versions stored with a completed booking or order, are kept as they were at that time. Updating a policy never rewrites an earlier record.
